A short time ago, defense attorney Michael Fienman assisted a Turkish man in his 40’s when he found himself in a difficult legal position after being cited for various charges stemming from driving without a license. One day, the man was pulled over in a car belonging to someone else and without a valid driver license. As such, the car was impounded and he was issued tickets for driving under a suspended license and driving without a license. His legal problems were further compounded when days later, the man went to the impound lot to retrieve some medication from the car. The impound lot attendant would not permit him access because he was not the owner of the vehicle. He admittedly became irate at not being allowed to get his medication and due to a language barrier between those involved, a heated argument followed. Police were called and subsequently charged the man with making terroristic threats, simple assault, and harassment. Faced with these additional charges, afraid of possible time in jail and the threat of deportation, the man hired attorney Fienman.

Once Fienman was retained by his client, he was able to mitigate these charges. With regard to the incident at the impound lot, Fienman used his cultivated relationships with the area prosecutors to arrange for his client to plead guilty to a lesser charge of disorderly conduct, which included paying a small fine. Additionally, he reviewed the original driving offenses and based on his extensive experience with traffic cases, he knew the incorrect citations were issued. He argued to the judge that since his client had never been issued a license in the United States, it was inappropriate for the officer to charge him with driving under a suspended license. The judge agreed and the man was found not guilty of the ticket. Fienman then negotiated to have the other offense of driving without a license reduced to a lesser summary offense. After another small fine, the man was relieved that under attorney Fienman’s capable representation these serious issues were effectively addressed.
