When a professional license is required in a particular field, it is not uncommon for applicants to be asked follow-up questions regarding their credentials and background. In some cases, these topics can be sensitive, and you may be reluctant to provide a full answer for fear of doing more harm than good. Not long ago, professional license defense attorney Michael Fienman was contacted by a recent nursing school graduate after the Pennsylvania Nursing Board requested additional information. Evidently, the woman was previously charged with assault over ten years ago, and despite being completely acquitted of the charges and upfront about the incident on her application, she was worried about how to respond to the Board’s request for additional information.

To avoid further delays, and the possibility of unfairly being denied her professional nursing license, attorney Fienman drafted a letter to formally settle the matter. By providing the necessary documents and firmly clarifying the issue, Mr. Fienman showed that his client was legally exonerated of the charges that appear on her background check and she should not be precluded from holding a valid nursing license. As a result of Mr. Fienman’s reply, this client was cleared; the very next day her license was issued and she became a dully licensed registered nurse in the Commonwealth of Pennsylvania. She started her new career the following week.
