During a traffic stop, police officers in Upper Darby, PA detected the scent of marijuana and after discovering the substance and a smoking device, they charged the driver, a 23-year-old man with possession of marijuana and paraphernalia. This young man wanted to avoid having a drug conviction tarnishing his record and limiting future employment opportunities, so he contacted Delaware County attorney Michael Fienman for his legal opinion.

Attorney Fienman is very familiar with handling marijuana cases in Pennsylvania and successfully negotiated on behalf of his client for his enrollment into the Accelerated Rehabilitation Disposition (ARD), for the second time. This is an astounding result considering that ARD is a diversion program usually limited to first-time offenders. After the client completes the program, which includes some community service, a small fine, and participates in 12 months of phone reporting probation, he can file for an expungement, accomplishing the goal of removing the incident from his record

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
