A Delaware County man faced a double whammy of criminal charges for two distinct incidents: a DUI and a charge for aggravated assault of a police officer following alleged domestic violence. His sentencing guidles dictated three to six months in jail for the charges. Following his failure to appear in court, a bench warrant was issued for the client’s arrest, which later landed him in jail.
Attorney Fienman was hired by the man’s family hours after the arrest and snapped into action right away. The client was out of jail within a day. Fienman met with his client, heard the man’s story and passionately advocated for leniency, citing the client’s career growth and continuing education in the time since the bench warrant was issued. Ultimately, a favorable resolution was reached where the client pled guilty to the aggravated assault charge but served no jail time. He was credited with time served for the DUI and agreed to five years of probation.
The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
