License Suspension Lifted for Man Originally Denied an Appeal

Mar 06 2019, by Michael Fienman in Case Results, Criminal Defense, Traffic Defense

A man in Philadelphia recently found himself in the all too familiar situation of being stopped for running a stop sign. While this is a pretty mundane traffic infraction, what made this situation complicated was that when the officers ran his information, it came back that his license had been suspended for some time. Evidently, he had been previously ticketed for another incident and failed to deal with that matter properly. So, unbeknownst to him, he’d been driving under a suspended driver’s license. Believing he was savvy enough to deal with the matter on his own, he appeared in traffic court without a lawyer.

In what would have been a routine matter for an experienced traffic lawyer like Michael Fienman, the man actually created a lot of aggravation for himself. Having missed his appeal deadline, he finally contacted Fienman Defense to pursue his remaining options. In order to effectively deal with the situation, attorney Fienamn filed a Nunc Pro Tunc appeal to deal with the timeliness issue of the case and upon successfully appealing this matter, began working to resolve the matter permanently.

Ultimately, and based in large part to the man’s wise decision to retain a veteran traffic attorney, the suspension violation was thrown out and the stop sign citation was reduced to a zero point violation. His decision to finally engage an experienced and skilled attorney was the difference in the man keeping his license, avoiding all of the trappings of a license suspension and having the stop sign citation reduced to zero points.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
