A Norristown woman was arrested in Montgomery County on suspicion of DUI following a car accident that she was involved in. When the police arrived at the scene of the accident and interviewed the woman, she relayed that she was on her way home after receiving her methadone treatment at a drug addiction treatment facility in Doylestown. She was charged with driving under the influence when her blood test results came back positive for methadone – a controlled substance.

She hired Montgomery County DUI attorney Michael Fienman to represent her. This case was worth fighting because the Commonwealth’s evidence was flawed. Michael consulted with a veteran toxicologist to potentially serve as an expert witness at trial.

Ultimately the case did not go to trial. Michael was able to negotiate with the Commonwealth for the client to be admitted into the Accelerated Rehabilitative Disposition program. It is very unusual for a methadone patient to be admitted into ARD in Montgomery County, so this was an optimal outcome. Our client will only be required to serve a probationary period of six months.

Because of the ARD admission, our client has a favorable outcome and she will be able to have her record expunged after the completion of ARD.
