Mistaken Identity in Retail Theft Leads to Dismissal

Attorney Michael Fienman recently assisted a man when some shocking allegations and a criminal summons severely complicated his life. A man that closely resembled Fienman’s client was photographed stealing from a Giant food store in Bucks County via the store’s surveillance system. Despite the discrepancy in appearance, the man was charged sometime later and contacted Fienman to deal with the situation.

The overzealous police officer and prosecutor handling the matter on behalf of the Commonwealth did not see the dissimilarity and wanted to move forward with a trial. However, on the court date, the Commonwealth was underprepared and tried to get more time to present their case. Attorney Fienman vehemently argued against an extension of time and the judge agreed. While attorney Fienman was extremely confident in his ability to exonerate his client based on the issue of identification, he was able to have the matter dismissed beforehand thus saving his client significant time, aggravation and expense.
