Horseplay in a school parking lot left one student with a traumatic brain injury and the driver charged with Aggravated Assault, Reckless Endangerment, and Simple Assault. The tragic incident was the result of one teen jumping on the hood of car driven by another teenager. When the driver hit the brakes, the fall left the other young man seriously injured.

Attorney Michael Fienman fought to have the case adjudicated in juvenile court, a tough job given the victim’s injuries and that it occurred less than thirteen hours before his client’s 18th birthday. Despite pressure from the victim’s family for an active jail sentence, attorney Fienman successfully kept the case in juvenile court and after exhaustive discussions with the prosecutor, review of surveillance tape, and recognition of the victim’s participation in the incident, Fienman resolved the case with probation for his client.

The terms included community service, restitution, suspended driving privileges except to work and school, plus a handful of weekends at the juvenile center. As long as the young man successfully completes probation, his record will qualify for expungement, giving him a clean slate and the ability to put this tragic incident behind him.
