Case Results

A Villanova student was charged with speeding in a work zone, careless driving, and failure to produce documentation when it was requested by a police officer. The officer alleged that the student was driving 44 mph over the posted speed limit during construction and was weaving through traffic.

The student is active in Greek life at his university and dreams of someday becoming a lawyer. He had prior traffic offenses on his record. Adding convictions for speeding in a work zone, careless driving, and failure to produce documentation could have cost him his license.

The student hired Philadelphia criminal defense attorney Michael Fienman to represent him in Montgomery County Magisterial District Judge Court 38-1-10. After thoroughly reviewing the case, Fienman discovered that the trooper who cited the student was not in a position to have observed the acts as alleged in the charges. The evidence was insufficient to support the charges.

Fienman negotiated a plea on the student’s behalf. The prosecutor withdrew the careless driving and failure to produce documentation charges. The speeding citation was reduced to 20 mph over the speed limit and the work zone portion of the charge was dropped. The student got to keep his driver’s license.
