Out-of-State DUI to be Expunged after ARD

When a man from Wilmington, Delaware was charged with a DUI involving property damage in Pennsylvania, the outlook looked bleak. Pennsylvania punishes drunk driving offenses with very stiff penalties including large fines, mandatory jail sentences, and lengthy license suspensions. A 60-day license suspension was imposed but it only applied to driving within the Commonwealth of Pennsylvania. Mr. Fienman’s client was able to retain driving privileges in his home state. Furthermore, after successful completion of the ARD program, the man is eligible to have the entire incident expunged from his record.
