As an experienced Philadelphia drug attorney, Michael Fienman fights to ensure people with addiction issues are not penalized too harshly. Not long ago, a young nursing student was charged with drug possession after she was found in her car, suffering from an apparent overdose.

Attorney Fienman used Pennsylvania’s Good Samaritan Law to have the drug case dismissed, but the young woman was then charged by the overzealous prosecutor with a drug-related DUI because she was in the driver’s seat of her vehicle when she was found unconscious. This complicated her situation, exposed her to significant penalties (including loss of license) and jail time.

Typically, heroin cases are not eligible for ARD in the particular county where the crime occurred. Undeterred, attorney Fienman aggressively continued fighting for his client and ultimately negotiated to have her admitted into ARD. This allowed her to get help with her underlying issues, and once completed, the DUI will be dismissed and eligible for expungement.
