A man from Philadelphia contacted criminal defense lawyer Michael Fienman for representation in a unique Accelerated Rehabilitative Disposition case. The man was admitted into ARD back in 1999, completed the program, but never filed for expungement. The man is now applying for jobs and the incident is preventing him from gaining meaningful employment because the charges still appear on his background check.
This case proved to be quite difficult because the records were old and Philadelphia Municipal Court was unable to locate the documents that were requested by the prosecution. Notwithstanding, during the court hearing on the expungement petition, Fienman fought against the district attorney, and through the zealous advocacy for which he is known, justice was delivered. The judge agreed with attorney Fienman’s argument and the case was successfully expunged.
The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
