Probation and Expungement for Felony Marijuana Possession

Aug 25 2021, by Michael Fienman in Case Results, Marijuana Charges

Originally arrested with an alleged 37 grams of marijuana in his possession, as well as paraphernalia, the man was charged with felony possession, felony criminal use of a communication facility, DUI, and possession of an instrument of a crime.

Despite facing multiple drug-related charges, including two felonies, he was ultimately admitted to the Section 17 program. This program requires one year of probation before the case is eligible for expungement.

Given the original charges, this outcome was unlikely at first, but Attorney Fienman negotiated  for the man to plead to an ungraded misdemeanor, which allowed access to Section 17.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
