Concealed Carry Issued on Appeal

May 13 2020, by Michael Fienman in Case Results, Criminal Defense, Firearms/Weapons

We recently assisted a man in Philadelphia when his application to carry a concealed firearm was denied. The man was confused because to his knowledge he had a clean criminal record.

Attorney Fienman investigated the situation and discovered that the denial was based on a past domestic violence charge despite never being convicted. Since this should not have triggered the denial, attorney Fienman appealed the decision.

Because he had an attorney to articulate his argument, highlight his clean record, and present the fact that his past girlfriend declined to prosecute the matter was quickly seen as a harmless spat between domestic partners.

As a result, the wrongful denial was reversed and our client was issued a lawful concealed carry permit that may have otherwise not been possible.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
