Assault Charges Withdrawn after an Altercation Between Neighbors

After buying a gallon of water, our client was walking down the street in Philadelphia when a neighbor approached and accused him of damaging her car. While the neighbors had a previous argument about a similar incident over a year ago, the man denied hitting her vehicle.

The altercation escalated and became physical with punches thrown by the female and the man retaliating by striking her with the water he was carrying. During the confusion another neighbor came out and brandished a gun, leading to someone calling the police.

When officers arrived, the female claimed that our client had a firearm. He denied this, no firearm was recovered following a search of his person, but nevertheless police threw him on the ground and arrested him for misdemeanor assault and summary harassment.

Attorney Fienman reviewed the evidence and worked to protect his young client who had never been in legal trouble before. By meeting with the prosecutor and pointing out everything that was wrong with what happened, including the significant criminal history of the complainant, Fienman negotiated to have the charges withdrawn.
