Pennsylvania criminal defense attorney Michael Fienman recently represented a man with a DUI in Philadelphia after hanging out at Woody’s Bar. He was on his way home driving down Broad Street when he was pulled over for swerving. After taking a breathalyzer test, he was recorded to have a BAC of .133, which placed him in the High BAC category under Act 24 of Pennsylvania law.

When the man contacted Fienman Defense, it was his first offense within ten years of committing a prior offense. According to Pennsylvania Department of Transportation (PennDOT), attorney Michael Fienman’s client was facing up to six months in jail, up to a $5000 fine and a 12-month license suspension.

After extensively reviewing the material on his client’s behalf, Fienman succeeded in getting the results of the chemical tests thrown out. In the end, his client pled guilty to general DUI general impairment – the lowest tier first offense. The client avoided jail time. No license suspension was given and at the client’s request, the case was never taken to trial.
