Retail Theft Charges Resolved Through Reduced ARD Program

Jan 18 2019, by Michael Fienman in Case Results, Criminal Defense, Theft

When a 56-year-old female executive was charged with multiple counts of retail theft and receiving stolen property for shoplifting from a department store on City Line Avenue, attorney Michael Fienman strived to deliver the best possible result. It became apparent that his client was acting out due to some personal issues and after counseling her, she decided to enter treatment. She responded well to the process, and by presenting her progress, attorney Fienman was able to eliminate some of the charges. By reducing the number of charges, attorney Fienman was then able to negotiate for her admittance into a diversion program. His client was initially given a 24 month ARD program, but Fienman was able to have the term reduced. By the time they went to court for admission into the ARD program, his client was only required to complete 18 months of probation, pay restitution, and perform community service hours. This allowed her to continue with her treatment, have no impact on her employment and quickly move on after a difficult experience.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
