A Philadelphia hospital employee who received home care following complex surgery was charged with multiple counts of Medicaid fraud because he clocked in/out for his home health aide who was found to be fraudulently billing for overlapping hours. Although he did not receive any of the improperly billed funds, he admitted to clocking the home health aid in and out. As a result, the man was charged with conspiracy to commit Medicaid fraud and ultimately the Court held the man responsible jointly and severely liable (along with the home health aid) for the full amount.
Attorney Fienman successfully negotiated a resolution that reduced the charges from 11 counts to a single third-degree Medicaid fraud charge. Because of the reduction in charges, the client was able to avoid jail time and move forward without the most serious penalties.
