A Central Pennsylvania Physician Assistant found herself caught in a DEA investigation after her supervising physician instituted an illegal “takeback” policy for unused narcotics at a hospital-affiliated palliative care practice. Following hospital protocol, the health system alerted the Pennsylvania Department of Health, which in turn notified the DEA. While the DEA sought to implicate multiple providers, including the PA, attorney Michael Fienman stepped in to protect her license and career.

He also negotiated with DEA agents, narrowing the scope of questioning and ensuring his client only provided carefully advised statements.

Because of this strategic license defense, the PA avoided disciplinary action, criminal charges, and permanent damage to her professional record. While she ultimately chose to leave her position voluntarily due to concerns with the health system’s culture and practices, she did so on her own terms—protecting her name, her license, and her career trajectory.
