ARD for Felony Insurance Fraud

Apr 16 2019, by Michael Fienman in Case Results, Fraud

Attorney Michael Fienman recently assisted a woman when her former employer’s claims led to felony insurance fraud charges. While working for a third party healthcare facility, she was in charge of billing, and some concerns arose about how she managed her time versus what she was billing for. Eventually, she was separated from the position, and her actions were referred to the Attorney General. While the woman moved on, became engaged, and found a new job, eventually the prosecutor decided to pursue felony insurance fraud charges. A conviction would have devastated the life she was building and probably resulted in time spent in custody.

Once attorney Fienman was retained, he immediately set to work. After extensive negotiation and working with the prosecutor, attorney Fienman put together an agreement that allowed his client to pay restitution and be admitted to the ARD program, which is a rare occurrence in felony cases. Once the terms of ARD were completed, the felony insurance fraud charges were dismissed, and she was finally free to move on with her life.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
