The DEA investigated a psychiatrist (of more than 35 years) for prescribing controlled substances without maintaining proper medical records. Some of the prescriptions were for close acquaintances, including a family member. As federal oversight on psychiatric medications tightened, the DEA audited his practice and requested patient files, ultimately leading to an enforcement action.
Attorney Fienman was retained and worked to mitigate the consequences. By negotiating a resolution, the psychiatrist was able to continue practicing for several months, allowing for a natural winding down of his practice and transition into retirement rather than an abrupt suspension at the tail end of the doctor’s otherwise long and successful career.
This approach avoided criminal charges, prevented significant fines, and minimized reputational damage by keeping the matter private during the time of the doctor’s planned retirement. Ultimately, he voluntarily relinquished his medical license, but with significantly reduced penalties.
The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
